Relocation

Relocation with a child/children can be a difficult procedure. Both parties need to keep the child’s best interest in mind, as well as living conditions, travel times, provision, safety, and the thoughts and wishes of the child. Moving away can also effect the parents, finances and cost and time of travel etc., so there are many factors to consider.

In Idaho, a parent seeking to relocate with a child after a divorce, or when a child custody order has been established, generally must prove a "permanent and material change in circumstances" and demonstrate the move is in the child's best interest. If the relocation is within a 50-mile radius, it usually requires the other parent's permission or a court order. However, relocation to another state generally requires court approval, and the relocating parent must prove a change in circumstances and that the move is in the child's best interest. 

This procedure can also be very sensitive and depends on the proceedings surrounding each individual case. You never want to take a child without the courts approval across state lines, or you could be forfeiting your rights to custody.
